The AC21 determination of whether a new job is in "the same or similar occupation" is made based on a comparison of the new job duties and those set forth on the original labor certification application. Job titles are not controlling. So, you need to have a copy of your original LC application and then compare the job description it contains to the duties of the new position.

My EAD expired in June 2007? I want to get EAD now. Bymistake I discarded my expired ead which is needed for renewal? Should I apply for its renewal or a new one?

Hi,
I recently upgraded by I-140 to Premium processing. Soon after the filing of I-907, my status on USCIS status website changed from initial review to Acceptance. The message displayed is that my case has been rejected because of incorrect filing fees. I contacted my lawyer and he is confident that my upgrade was filed properly. He also told me that he has been observing same issue for several clients ,where USCIS website is displaying incorrect message. I am not sure what should be my next step. Is it something I should be worried about?
Is there some one with similar experience ?

Hi
I got laid-off in Jan'09 and was not able to get a job. I returned back to India on 01-May-2009. I would like to come back to US since the economy is coming-up. Below is my situation:
Filed I-485 and it is in Pending status (Priority Date is May-2007). I-140 approved in Jan 2008.
Renewed EAD which is valid till July 2010. But AP got expired by 15-July-2009.
6 years of H1B expired by 31-May-2009.
1. What are my options now to come back to US?
2. When can I file for my new H1B? I heard there should be 1 year gap between H1B.
3. Will I be considered in regular quota OR I will get H1B on previously held quota?
Your suggestion will greatly help. Appreciate it.

I mean, will it matter if someone applied for 485 on July 30th or August 17th, other than trying for an EAD and AP earlier ?
2. Is there a benefit of applying early in the timeframe, in getting an approved 485 ?
Please respond at your convenience.

I am currently working on H1B visa. I also had an EAD which expired 2 months back & I applied for renewal of the EAD last month. I am at the risk of being laid off by my current employer & they will withdraw my H1B if that happens. Here are my queries-
(1) If I lose my H1 status & my EAD approval is still pending, what do I need to do? If I am unable to find a new H1B sponsor, will I have to leave US immediately?
(2) Will my H1 cancellation have any effect on my EAD & AP renewal petition?
(3) Can I return to US & work after my AP & EAD are approved?
(4) If my EAD approval happens before my H1B visa is revoked, can I legally stay & work in US on the basis of ONLY the EAD?

My AP approvals are lost in mail, my employer mailed them in ordinary mail during holiday season (12/11/07). What can I do next? Go thru attorney for duplicates? Please advice.
USCIS will not issue duplicates for AP, you will have to re-apply with a fee.

In preparation to file I485, we just had medical tests and the doctor checked the box " Applicant does not meet immunization requirements" in my son's report citing the reason insufficient dates.
What is the impact of this ? How this can be remediated ? Any suggestions by those who experienced similar situation would be greatly appreciated.
