My wife's EB2 I-140 is pending. Now we find that the job description on the labor certificate does not qualify for EB2. We are going to file a new application for Eb3. But the original LC has been submitted in the last EB2 application. Please advise what we should do. Thanks!!!

Hi Gurus,
There was a minor RFE on my wife's I-485 (incomplete form I-1485 - a tick mark was missing) on 18 June. Our lawyer received the RFE and forwarded to us (I am not sure if we also are supposed to receive a copy of the RFE directly from USCIS but we did not). We replied to it and the lawyer sent it to USCIS this week such that it would have been received by USCIS on 1 Jul 09(Wed). I was expecting to see a status change to something like "Response to request for evidence received, and case processing has resumed". However, the case status changed to "Document mailed to applicant".
I am puzzled with this. Does anyone have a similar experience? Any guess what it might be?
Just getting anxious.

Hi Everyone,
Just curous - if anyone has experience of filling W8-BEN form. Our bank has sent a letter addressed to my wife requiring her to fill that form.
Does anyone know we have to fill this form?
Aren't we "RESIDENT" fom IRS point of view.

I was working with company A and got approved I140(1 year back) after that I moved to company B using approved I140 and got 3 yrs H1B extension.After that during July,07 period I requested company A to apply EAD and i485(Company A mentioned as future employment).Now I am still with company B.
But now Company A asking me to come back.Since I have everything approved (i140) except i485(pending) do I need to go back to company A?
If I do not go to company A,can he cancel approved I140 ?
Need help/suggestion .

My H1B expired when I renewed (last month) my EAD. I e-filed it and selected H1B "SPECIALITY OCCUPATION". I got my new EAD card in hand within 22days from the day I filed.

Am currently in my 7th year H1 and have got admission into a parttime MBA program!
1.) I just wanted to clarify if i can accept scholarship in form of tution waivers? (not a income?)
2.) I am aware i cannot accept any scholarships which may require me working as a TA or RA? as this is a income...
but is a non-income school sponsored tution waiver an accepectable option>
Any gurus on this board like to throw some light on this!!!:confused:

We should think of starting this thread to organize bus rides from Texas. If we use U.S. Coachways, which is in most major cities, we could potentially have buses leave from the major metros (Houston, Dallas, San Antonio and Austin) or two or more buses leaving Houston and San Antonio in the south and picking up more people as they make their way north to Dallas and Austin. Beyond Texas, the buses could also pick people up in Louisiana, Mississippi, Alabama, Georgia, etc, or other states depending on the routes. Also, a great and reliable local Dallas bus company is "Buses by Bill"

You can have 2 485s pending at the same time - this happens fairly often. Once CIS is ready to approve one, they will ask if you want to withdraw the other. You may not get approved for a second EAD and AP, however, while you have valid versions of these.

Hi,
My H1B was approved with a start date of 12th Dec 2010. However, the paperwork for the position has not been completed as yet by the HR of my employer and now they tell me that the start date of my position will be around the middle of Jan 2011.
This means that I will not get paid till the actual start of my position. So what is my legal status right now.
I have been told that on a H1B visa, If I am not working and getting paid for the position I was approved for, I am illegal.
Please advise me as I still have time to convey the issues to get the paperwork done right. What happens if my H1B start date is the 12th of Jan and my job paperwork shows position and pay from the 15th of Jan?

Hi All,

We had filed for extension (form I 539) in California Service Centre with receipt date of Jan 02 2008.
Calif is currently processing Oct 2007 I529s.
My concerns are :
1) I think their stay here is legal till we hear back from USCIS on their extension. Please confirm if this is true.
2) If they get declined , they have to leave immediately. Is that period of stay considered illegal?
3) Is overstaying with legal extension an issue if they need to come again after 6 months or so? What is the criteria they look for for frequency of visits/stay periods at port of entry.
Will greatly appreciat all your personal experiences /wise opinion on this matter of pressing concern for us.

I am planning to apply for Alberta Nomination Program under NOC (Manufacturing and Industrial Engineers). Does anybody has any experience with this NOC. Also, I need to know how does this process work. I apply for ANP and when I need to move I apply for jobs and then I get work permit...right ? Then if I need to get a TN visa to come back to usa how do I do that. I have a house in chicago, so wondering if renting that out could be an option for me when I immigrate to alberta so that when I need I can come to chicago. I am in my 5th year of H1B and with the current scenario my present company is not going to start my GC (it stopped because of layoffs in the company).

(2) I am planning to apply(say by August 1st, 2007) for 140/485 concurrently in EB2-NIW category, as the PDs have become current.
Will my OPT be rejected because of the pending 485? Is it possible to file 140/485 concurrent or should I wait till my OPT is approved (by that time the PDs will no longer be current...hmmm). Your valuable suggestions are needed. Pls help me....
