If the labor from BEC gets approved and subsequent I140 as well, is it possible to request only the priority date change for the I485?
Not refering to replace the I140. IS IT POSSIBLE TO JUST REQUEST THE PRIORITY DATE?

B1 is purely-non-immigrant-intent visa while H1 is dual-intent. Given this, I do not see any harm entering on B1 while you have a valid I-797 presumably starting Oct 1st? So, after returning you can appear for H1 visa stamp and later enter using H1.

Hi,
1> Presently i'm working for company A and wants to transfer my visa to company B. After transferring my visa to company B, if i don't want to join immediately to company B and want to work for some more time in company A itself. Is this possible? If it is possible how many months i can hold my H1 visa of Company B or Max after how many month i can joinvto company B?
2> Presently i'm working for company A and i had a bond in India with this company an amout of $9000. if i leave the company within 1year I should pay this amount to the company. If i break the bond and join to other company, do i really need to pay this amount. Please help me.

Hi!
I traveled to India and came back on 22nd Feb'2009. I am on EAD and travelled on AP.
At the immigration, I got I-94, which the officer stamped till Feb 21, 2010 (parolled until). However, my EAD is valid till (7th August,2010) 08/07/2010 (mm/dd/yyyy).I got my AP renewed till Dec'2010. Shall I be concerned about my I-94 till Feb21, 2010 (need to renew it?) or it doesn't matter as my AP is renewed and will renew my EAD 3 months before it expires? Pls answer.

Labor approved(eb3 with pd of July 03),
I140 in process,
In my seventh year of H1b on a one year extension expiring in August.
Please advise if I can change employers now and still get a new H1 though I am in my seventh year ?

Hi,
I was working on H1B till one month back, recetly I joined permanent position on EAD. I need to renew my wifes EAD. Though I dod not need it but for driving license they want some immigration document, so I am planning to e-file for my wife's EAD. I have couple of questions
1. There is question for Current Immigration status. I belive since I mobved to EAD my wif's status is AOS pending. But from the option I do not see any option near to that. What should be right choice. It is not a manadatory field can I leave it blank.
2. There is question for Provide information regarding eligibility status. What should i put there , I am thginking to keep AOS Pending.
3. Somebody told me that I can not e-file for my wife.

When I joined my employer, I had MS+2 years of experience, but my lawyer applied to me under the EB3 category which had MS+2 as an alternate qualification. I submitted the experience letters from my previous employers.
Now, my company is willing to upgrade from EB3 to EB2 and have a position that requires MS+2, but the job responsibilities is a little different from the EB3 job.
If I apply for this position, will the USCIS accept the experience letters submitted earlier?

My I-140 finally got approved last week. I'm a concurrent July 2nd 2007 filer. My I-140 was initially denied and was approved on appeal. The process took some time and created a new problem for me.
I looked at the USCIS website and they're currently working on cases filed on July 16. It seems my case (485) came and was passed on as my I-140 was pending at the time.
What can I do now?

I think you need to reapply for H1 again (unless you are transferring your visa category to H4).
