The New York Times recently ran a profile piece on radio show host Filemon Lopez who broadcasts in native languages from a station in Fresno, California to poor Mixtec Indians from Mexico working in agriculture in central California. Lopez, a beneficiary of the 1986 legalization program, has been in the US for 30 years. He brings a little piece of home to immigrants performing backbreaking work to put food on our tables.

Will there be any chance to revoke or cancel approved i140 if we file 2nd i140 with same employer . My employer is willing to give approved labor which is better (EB2 ,PD-2003) than my labor (EB3, PD-2003) . But right now i am on 6th year . I got a 3 years H1B extension recently. If my first i140 canceled (??) how about my H1B . is it still valid?

My husband and I are in a big Dilemma whether to apply for EAD or AP? In the lawyer's note,it says that anyone who is I-140 Beneficiary will not be able to use EAD and AP. Is it true?
We are on our 3 years H1/H4 using I-140 benefits only. What should we do?
Please guide us.
We still have 3 years remaining. Problem - We both have no visa stamping after we got our extentions which why AP is required at this point?
Are there any travel restrictions after we file I-1485 with AP or WITHOUT AP.
Please highlight. Will be very useful for us.

Hello All,
I need some advice here. Actually I have filed two labors.
Company -A - EB3 - PD of March 2003
Company -B - EB2 - PD of March 2006 (PERM)
I got my Labor, I -140 from company B, and applied for 485 recently (July-2nd).
Recently (Last week) I got the labor approved from Company A (as it went to Backlog).
I was thinking that If I get I-140 from Company A then, My layer wants to use that Priority date in already filed 485 case.
But to get the I-140 from the Company B, I may have to spend around 3k, so just thinking if it is worth doing or not.
Any suggestions?

Once you get married and get your License your spouse can file for I-130, I485 concurrently. You can file for EAD and Advance parole also along with this you need affidavit of support I-824

Dear members,
I am working in India. I have an L1 petition which is valid from sep 2004 through sep 2007 from my company. When I went for visa stamping in 2004 the visa officer gave me a visa valid from sep 2004 through Nov 2005. This meant that I could enter US only in the first year of my petition but continue to stay legally in US on an I-94 through Sep 2007. As of today, I may have to leave for US in March 2007 on this L1 and my question is that if I go for a renewal at the US consulate will they renew my visa for a petition that will expire in Sep 2007. Considering that there are only 7 valid months left on the petition.

My case: NIW 140 approved, PD 2006/10, now 485 pending. But I am leaving USA to another country for a permanent job. I am not sure if I should withdraw the 485 or just convert it to CP.
1. Will it be possible for me to get the green card thru CP if I get interviewed and can't show any ties with USA? Can I enter USA during CP? I hope to have green card in case I don't like my new job and come back to US someday. But I may just cancel 485 in order to affect the least my future visiting visa application. Suggestions?
2. I am on H1 now, but H1 will expire 1 month before I leave USA. So I understand that I can stay legally on AOS for the one month, true? Do I need to do anything for switching from H1 to AOS? Again, I need to come back to USA for business/visiting, so I want to do everything right not to harm my future non-immigrant visa application.

Dear Core Team,
What is IV's stand on people still stuck in LC backlog in PEBC/DEBC, There are applications pending there since 2001/2002. If this becomes law that I-140 filed after May 2007 will be rejected then the biggest impact will be on such people as even labor is not cleared and even after waiting for so long they will lose everything.

Hi - I am currently on an L1 blanket visa and it looks like my company will sell the unit I work for in the US. The parent company will sell the US division - I am currently in the process of applying for my GC - with the I40, and I485 both pending. I had my biometrics done today.
Want to gain some views on what my options are if the GC route does not pan out. I am on a UK passport, and would like to remain in the states. The GC is an employment based application - which is apparently quick, but I want to have a plan B. Is the next best option the H1B, and if so, will I be able to apply for this (if needs be) inside the US with another company if they are prepared to take me on?

Hi,
Recently we moved. So I did not apply the AP renewal(a two month window) till we move. But now my wife has extreme family accident/emergency in India. So we applied for AP online and went to Chicago field office (we went there because kid also need INDIA VISA STAMP) and to Milwaukee office with letter from document. They said that they would not approve. So I have sent the support document s for I-131 to the Texas Service center in overnight courier service today. I have H1 valid till may 2010. What are my options?
Does her travelling on H1 with AP pending will cause problems to I-485?

I joined new job using EAD, didn't invoke AC21, my 140 was approved and I filed 485 in July2007.
There was a RFE for geographical discrepancy explanation and EVL from 140 filed employer or EVL from new employer if changed jobs on 04/29/2009.
(Changed address using AR11 after filing 485)
RFE on 485 on 04/29/2009
LUD on 140 on 05/01/2009
USCIS received EVL from new employer with AC21 - on 05/11/2009
LUD on 485 on 05/13/2009
LUD on 485 on 05/14/2009
Don't know whether they are soft LUD or Hard LUD.
Couple of questions, Is LUD on 140 normal when there is a RFE on 485?
Continuous LUD's on 485 normal?
