    And regarding problems at POE... its not totally true but at the same time you cannot
    rule out totally also.
    so basically keep all the required documents like your employer letter... and
    if possible your client letter showing you have job when you come back and
    also your recent paystubs.

    Normally, entering into the US follows the last entry rule. Thus, whatever status a person last enters on is their status.

    There are special regulations when it comes to H-1b status and travelling on AP. I would speak with an attorney prior to travelling.

    I faxed senator's office on sep 9th , then called this monday and they said I should get a response of inquiry in 30 days. No help from congressman's office. It has been more than a month after mailing the letter to them and folllowing up by phone calls. I have given up..

    I would like to know more about inquiries through NJ senators too..

    Does anyone,please could help me with the following query?

    If my I-140 is not approved yet, is Uscis touching my I-485 application....in other words is I-485 being processed (not approved, only processed)even if I-140 is not approved?( I applied concurrently in August 2007, and my priority date is current, Eb3 ROW).

    I would highly appreciate your reply!

    I just got a CRIS notification that for my case and my wife's case "Card production has been ordered".

    Does that mean our I-485 has been approved?

    I'm from India, EB2, PD Mar 16 2003

    Gurus,
    I filed for AOS during July 2007 fiasco. I filed I-140 (Company A)concurrently with I-485. This concurrently filed I-140 got denied. I had another approved I-140 (Company B)from a different employer. My I-485 is still pending. Is there anyway to use AC-21 to reuse old approved I-140 for this pending I-485? Thanks for your valuable inputs.

    Hi Guys,

    A friend of mine from India is getting married to a US citizen here. She is coming here on a Fiancee visa (i believe K or V one of them). Does anyone know how long it takes to get a Green Card if you marry a Citizen?


    Any help will be appreciated.

    I think it is within 6 months. Check the USCIS website for the I130 petition time frame (CSC).

    I have no LUD at all for my 1-140 which was approved 6 months back. The status message still stays "...processing..." !!
    So do not bother much about the online statuses and LUDs.

    The Chief of Staff of U.S. Citizenship and Immigration Service’s (USCIS) Fraud Detection and National Security (FDNS) office explained three different types of site visits being conducted by USCIS.



    Risk Assessment Program Fraud Study: program is part of a study to help design profiles of potential fraud. Family-based petitions or employment-based petitions once approved are randomly selected.


    Targeted Site Visits: this visit is to ask questions when fraud is suspected. Advance notice of visit is given.


    Administrative Site Visits: for religious worker and H-1B programs. Specific questions generally regarding the beneficiary’s job duties as stated in the petition and whether the beneficiary is receiving the wage as stated on the petition.

    The inventory number does not include the EB1 and EB2ROW filings, which are always C and out of queue/approved in less than 6 months. They are not shown in inventory numbers.

    DHS | Yearbook of Immigration Statistics (http://www.dhs.gov/files/statistics/publications/yearbook.shtm)

    Show that they approve over 60K per year on average (for past 10 years) for EB1 and EB2ROW (EB2 Korea is huge as well)

    When we calculate, we should deduct 60K from 140K

    The situation is not optimistic

    LC was approved in 08-20-07 but I-140 was not filed within 180 days according to new rules. has any body have this problem? will DOL or USCIS let it slip. please help.

    How Does USCIS check how long you are with your employer after GC ?
    if they check pay checks during Naturalization Interview ?

    Hello?

    In Mid 2007, 7th year of H-1B transfer & extension was filed, and was no problem as I had an approved ETA-750 with ex-employer, but it was expired soon as the sponsor�s (ex-employer) company was closed at the end of 2007.
    The 7th year approval period was 12/11/2007 ~ 12/10/2008 with the current employer.

    I filed another labor certification (ETA-9089) on 10/23/2007 which was sponsored by my current employer, and it has not been approved yet.
    Using this ETA-9089 pending more than 365 days, I filed an I-129 extension for 8th year of H1B last November 2008, but INS sent "Request For additional Evidence Sent" letter which was saying to be provided �An evidence of pending / being processed for more than 365 days of labor certification or I-140 prior to 6 year expired of H-1B�. we just realized that a memo was posted regarding this on 05/30/2008.

    As I don�t have this evidence... Please advise or recommend me...
