The Applicant should sign the forms and if he uses any Attorney or Paralegal they have to sign the G-28 form and also on the other forms submitted.

hi gurus, a question.
I am currently out of US but working for same company in Europe
I have approved 140, but waiting for PD to be current - (Jan/03, EB3-I).
I am now a sr manager and seem to be eligible for EB1C (if company agrees).
Option 1)
- continue to stay in Europe and apply for 140 (eb1c)+CP
- while waiting for 140 approval, am i eligible for: EAD and AC21 (after 180 days)
Option 2)
-move to US on L1 visa and apply for 140 (eb1c) + 485
Option 3)
- wait for PD for eb3 application to be current
Hope the above makes sense.
Can you pls suggest the best option & approx 'how much time' it will take for option 1 & 2. (understand option 3 is unpredictable).

Hello,
Please guide me in my situation.
I am on OPT right now which is valid thru May 2008. I have already applied for H1 through Company A in April this year. I got a job offer from Company B recently. I would like to join Company B and start working for it on my OPT. Company A failed to provide job for me so I wish to transfer my H1 (once after it is approved) to Company B. Now I have the following questions:
1. What happens to my OPT after I get approved for H1 through Company A?
2. Do I have to stop working for Company B as soon as I get my H1?
3. Can I transfer the H1 I get for Company A to Company B without any paystubs?
4. Can I refuse the H1 and continue to work for Company B on my OPT and then apply for fresh H1 in 2008?
5. Is there any possibility for Company A to cancel my status and make me go back to India?
Please help. I am totally lost and confused.....:confused:

Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one. He voted with anti-immigration Senators to filibuster the 2007 version of comprehensive immigration reform and there is little reason to believe his vote in 2010 would be different. On the other hand, Senator Lugar, his Republican counterpart from Indiana, is a much more likely vote in favor reform. Bayh may feel freer to vote...

Hi Friends,
My EAD expires in the mid of August.I am planning to go india at last week of July.I thought of applying for EAD renewal now.But my lawer said it is always preferrable that the candidate must present in US while processing EAD renewal.Is it ok if I apply for renewal after I come back from India.By that time,My EAD already expires.Will it be a problem If I apply for renewal after expiry of current EAD.I am currently on H1B visa and I am not using EAD status now.If it is a problem,I will postpone my India trip.

Dear all,
Myself and my husband both have approved I-797 for H1B from different US companies.
I went for my stamping to US embassy and they asked for more evidence regarding the US company and my case is currently pending with them with all my documents ( passport, I797, marriage certificate, etc).
Now my US company is not able to get a job letter for me.
Meanwhile my husband is planning to go for his stamping. He has good evidence to support his case.
My questions are -
1.) How can I retrieve all my documents from US embassy without affecting my passport and my H1 case?
2.) If I am able to retrieve all the documents safely, can I apply for H4 with my husband`s H1 stamping?
3.) Will they create problem for issuing H4 to me because of my pending H1b case?
4.) With H4 visa and I-797 approval notice, can I start working in US ?
5.) What will be the best way out of this situation without affecting our working visas ?
Please reply if you know anything.

See here for the permanent residence (PR) procedure: Family-based Marriage Immigration categories - Elaine Martin Attorney (http://martinvisalaw.com/family_lpr.html). Getting married or starting the PR process should not affect your company's L-1 extension petition.
