Hello,
I am on an O-1 visa married to a G-4 visa holder working for an international organization. My spouse's work told her recently that her spouse and other dependents have to be on a G-4 dependent visa unless they are a US citizen, green card holder or on their own G-4 visa.
1. If I change to G-4 spouse visa, I would have to wait 4-6 weeks before I get an EAD to work. So, I want to know if this is indeed true.
2. Can I continue to work on my O-1 until I get the EAD? Is there any way to expedite the EAD process.
3. Plus, I want to know about the portability of the EAD I can get through a G-4 visa.
4. Also, would this restrict my ability to apply for a green card in the future.

I was on F1 visa and applied for my GC / I485 thru my spouse few years back. Unfortunately while coming back from India 3 years back, I used my stamped F1 visa instead of AP. My lawyer told me that due to this, I have abondoned my AOS and he has to withdraw my 485 and refile it when it will be current. Few days back spouse became current and attorney was preparing to apply for 485 again but in USCIS the status of my application was still shown pending not withdrawn. To our surprise, we saw 2 GC in the mail and the online status was shown approved. But the attorney is saying that we should re-file the 485 since USCIS did not withdraw my application and approved it. They says that I might have issues if my absence is detected when I will apply for citizenship later. Please suggest. I am so puzzled and tensed..

I have applied for EAD renewal on September 1 2010. I have received receipt notice and checks are cashed . There was soft LUD on my case two weeks back without any change in status . To day I got email with case status � Initial Review� with following messsage
We have placed this case I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION on hold because there is a pending litigation that may affect the outcome. We will resume processing as soon as the litigation is resolved. We will notify you by mail when we make a decision about your case, or if the office needs additional information.

I got my PERM labor approved yesterday, for applying I-140 were can I find the processing dates for I-140? I mean specific to Country? Because, if I go to https://egov.uscis.gov/cris/jsps/Processtimes.jsp?SeviceCenter=NSC the processing time for "Skilled worker or professional" is April, 1 2008, does this date apply for all? Thanks in advance.

We received our H1B renewal approvals last week, and noticed on my wife's 797A that class type mentioned as H1B for the petition type I-539. It's supposed to be H4.
I informed our attorney and she emailed CSC about the same.
Has any one come across a similar thing ?

Keep an eye on the military appropriations bill Congress is working on for a potential immigration piece. The AP reports that Republicans want some serious money and personnel commitments for the southern border. And my own sources are telling me that some Democrats are looking at trying to get the DREAM Act in that same piece of legislation. Do not do this - please stop playing around with USCIS rules. There are sometimes unfortunate circumstances where folks lose status (e.g., OPT -> H1b) or are kept in dark about their H1B status by employers but for folks who break the law in a way that you are suggesting, I believe they should be punished.

My I-140 was approved in August 2009 and my PD is Jan-2004 (EB3). I want to know when i can apply for I-485, should i have to wait till my PD becomes Current or is there any other way by which i can file the I-485. Please shed some light on this topic and thanks for your time and effort.

Hello,
Your SSN is used mainly for employment and taxation purposes. You can go to India and come back without any issue ... the SSN will wait for you in your mailbox... :)

This is my first post. Thank you for allowing me to participate.
Just a passing thought - Would it help if members in each state meet (say on a Sunday) and come up with Strategies to mobilize more people in their respective states?
It will help the us organize better in each state. A senior member in each state would then coordinate and take strategy and activity related instructions and advice from immigrationvoice.org core members and implement those in his/her respective state.
If at all that is possible then immigrationvoice.org can maybe create statewise blogs or something that would update members in each states about upcoming activities.

Guys, Due to all this mess up with dates I decided to file 485/EAD/AP myself and for my wife on 6/29; so filled up everything, attached copies, photos and what not and FedExed all to USICS on June 30 to hit them on 2nd July.
Now I see that by mistake I have put my SSN on my wife's 765. She has been always on H4, never had SSN.
1. What can be the consequence of this mistake?
2. Should I try to pull it back from USICS and submit again (if it's at all possible)

One of the threads I read about requirements for I-140 smooth approval.
Please let me know
1.if anybody got any RFE's recently for getting I-140 cleared or processed. If so, what are they asking.
2. How important are salary slips in getting this approved
3. Are they asking for any recently pay stubs, if so, for how much period back in history.
The reason I'm asking this is sometimes we loose pay stubs, and hence I wanted to make sure I have all, in case any is missing.
4. Any risks in getting I-140 premium processed when dates are not close to current.
5. Any other risks.
6. How much time is it taking for regular I140 to get processed.
Any advice to this end is highly appreciated.

You could be in H1 till Dec 2010. Nothing in the law states that your already approved H1 has to be revoked, with the PERM denial.
