As a recent post by an immigration colleague notes, quite a brouhaha has erupted within the immigration bar and among purveyors of immigration case management software over a new outbreak of immigration singularity. Hello,
I have attended Toronto consulate on Apr 18th for my 7th yr h1b stamping. I have i140 approval. The consul gave me 221g yellow form and later received 2 emails asking for some documents which I submitted. I still have not heard any response and I understand it could take months before I get any answer. My question is can I leave Canada and go to India while the process is in review and come back to Canada if and when my H1b stamping is approved. I have multiple entry visa to Canada so I could potentially come back. My question is can I leave Canada while my visa is under process and would it have any affect?

Hi All
My wife changed her status from F2 to F1 and recently she went to India, so she had her visa stamping appointment on Feb 18. at the counter the visa officer told her that she hasnt paid the SEVIS fee so has to go outside and pay online and come back with the receipt. she did and went back and she was told that she has got the visa and the passport will be mailed to her. she hasnt received it yet (its about 8 working days now), and when i contacted the consulate they replied: "We have provided a pink sheet, which says that the SEVIS is not updated in the system. Once it gets updated the passport will be sent to the mailing address."
1. is this delay a normal occurance and how long it takes in such case?
2. do you guys see any problem in this case?
please advice..

Are you employed by a US firm. My only concern is that if you apply from indian and are out of US for an extended period of time, USCIS may assume that you have abandoned your immigration intent.

Hi,
I am being told by my employer that Prevailing wage applies for the hours from the start of an employment to the end of the year irrespective of any vacations.
I joined my current company in Feb 2010 and went to India for 1.5 months in Oct-Nov and came back, My prevailing wage hours is calculated from Feb 2010 till the end of the year ignoring the break I took when in India. So, even if I am paid for only the hours I worked here, I have to match the Prevailing wages based upon the hrs from Feb 10 till Dec end 2010.
They want me to pay them the difference as I had a low billing rate and my total earning is lower than the prevailing wage based upon this calculation.
I don't see sufficient information on the web for this clause.
Please help.
