    Keep an eye on the military appropriations bill Congress is working on for a potential immigration piece. The AP reports that Republicans want some serious money and personnel commitments for the southern border. And my own sources are telling me that some Democrats are looking at trying to get the DREAM Act in that same piece of legislation. Remember, DREAM allows for some who join the military to pursue permanent residency so it would be a germane part of the bill. A down payment on comprehensive immigration reform? Or the end of that effort and the return to piecemeal legislating?...

    I filed my I-485 and I-140 together in July 2007 using substitute labor (priority date) in Eb3 category.
    I have Master degree, so can I change my category from EB3 to EB2 and keep the same priority date?
    Thanks in advance and any help would be great.

    My company recently moved offices to a new location just a few miles from the old location. Its in an adjacent county but with in the same state. We moved from Northbrook, IL to Deerfield IL, does this warrant a change in LCA/H1B?

    New numbers are out on H-1B usage and the past week showed last week's substantial pickup was just noise. Only 800 visas were claimed against the 65,000 cap, half of last week's total and somewhat less than the typical weekly usage we've seen over the summer. 37,400 H-1Bs have been counted now. I'm moving my exhaustion projection date back a week. My target is based on a rolling four week usage average so variations from week to week are discounted.     Hi Folks,

    I have a unique situation. Well.. I have been working for a Company A that is owned by my uncle. Iam on H1B in 2nd year and I have my I-140 approved 1 month back. Now I got a new job in another company B with 3 times the current pay of mine. I want to change to the company B.

    My uncle said that he will continuing the process of my GC application, under EB2 in his company A. But I want to transfer my H1B only to the new company B, so I can get into the company B's payroll and get benefits. Can someone suggest how we can handle this without messing up with the current GC process with company A. Does changing to company B under new H1B impacts my GC processing. Can we show that the company A is processing my GC under future employement, though I worked for company A before..

    Please advise the consequences and my options.. I badly want to work for company B..without stopping my GC processing with company A..

    I appreciate your help in advance

    My uncle just received his L1 extension receipt. Lawyer was late in filing the L1 extension, but supposedly got everything ready and mailed it 2 days before the L1 expiration date.

    However, my uncle received recepit for L1 extension, and received date is 2 weeks after the expiration of original L1. Please note I am talking about RECEIVED DATE (not Notice date or receipt date).

    Does this mean extension will automatically get rejected based on late filing? Is there any recourse to this?

    More importantly, Is my uncle Out of Status now? (He doesn't have anything else going besides L1)

    Please let me know as soon as possible.

    The Department of Labor published a final rule, effective on June 29, 2009, that suspends the H-2A final rule published on December 18, 2009. DOL is republishing and reinstating regulations in place on January 16, 2009, for 9 months, after which the Department will either have engaged in further rulemaking or lift the suspension.
