Hi Friends,
I have a question, actually I worked with a for-profit company A for few years and then transferred my H1B to a not-for-profit company B last year. Now can I transfer my H1B to a for-profit company C?
Actually one of my friend told, it is not possible and I can transfer only to the not-for-profit companies as I am currently working with a not-for-profit company B. Is this true?

How come a govt. organization that is never known to do things on time, all of sudden is able to approve 60000 GCs in such a short period ? Why did they have to do it by end of June ? If they had done that by end of July would anything have been different for the folks who were getting the Green Cards - NO.
I think this was all planned. There was a reason why the numbers were made current and there is a reason why the numbers became unavailable.
I think we should get to the bottom of this. This stinks ......

I have an issue with my recent H1B approval on Feb'2010. I am seeking your advice in this regard.
I have been in H1B since 11/01/2005 , entered US on 04/20/2006 and my PERM has been already approved with a PD of 03/15/2009. My current I 94 is expiring on 4/13/2010. Recently I got an H1B extension approval of just 1 year (4/13/2010 to 4/13/2011) , which is less than actual 6 years with approved PERM.
Do you think that any appeal or ammendent can be done to extend the approval period? With my H1B petition I had to enclose a client engagement letter which confirmed my engagement but didn�t have any engagement end date there.
If you think that any appeal or ammendent can be done with USCIS, then kindly advise me accordingly. Thanks

You should check the EB3 ROW (Rest of the world) date in the visa bulletin which is published every month - Visa Bulletin (http://travel.state.gov/visa/bulletin/bulletin_1360.html)
The July bulletin shows the date as 15th Aug 2003. It's difficult to estimate when it'll get to July 2007 because the movement is not linear.

The Government Accountability Office has released a new report studying the accuracy of the E-Verify database. According to the report, the number of tentative non-confirmations has decreased by 5% over the last two years, an indicator that the system has more complete records than in the past. Robert Creamer has an interesting analysis of how the ruling in Arizona could affect the Democrats' prospects in November. Many pundits are assuming that Republicans benefit. But Creamer makes a point I've said here many times. The only voters who switch their votes on the immigration issue are Hispanics. Anti-immigrants NEVER vote for the Democrats anyway. They almost always have a host of issues that they care about and in most cases the GOP is the better fit for those voters. So Democrats who try and pander to the Tea Party types are wasting their time.

The Senate approved a stop-gap spending bill that will allow the Department of Homeland Security to operate until the end of October while House and Senate conferees try to work out a final version of the agency's spending bill. Good news for EB2-I people with 1999 and earlier PD's. They have been waiting far too long. Good luck for them. They have now done 10 years in the US, and will qualify for SS, anyway.

Hi,

1)I am on H1b visa and currently i am on bench. My 140 is approved and my H1b is expiring on sep30 ,2009. I got rfe for h1b extension asking for client letter.
Should i convert to h4 or do h1b transfer if i could be able to get someone to transfer it.
2) Also if I go to h4 visa will my green card processing with priority date remain same if i go back to same employer and ask them to file my h1b again after i get a project. Or they again have to start the process again even with same employer. Also what if i go with different employer.
3. If I apply for H4 visa now and in mean time i get a project before sep 30 2009, then what do I need to do. can i just ask my employer to again file h1b extension.
4) SO if I do h1b transfer or go on h4 what are the pros and cons.
Please let me know ASAP.

Hi i've been reading the forum for a while now and I hope that you guys can help me out. Like most people i have more questions than answers.
I just got my i140 approved (Sept 24,2008 or so).
The LC was file around Apr/Jun '07 so i would assume this is the Priority date correct?
My lawyer tells me that while this is great, we still have to wait for visa numbers to become available to file the 485. Any suggestions on when is this gonna happen?
I know that this is somewhat linked to the visa bulletin ... how should i read it to understand in a few words, when is my time?
Once i've filed i485 how long does USCIS takes to process it?
On the other hand, i'm quite anxious about changing jobs. If I do, do I waste all this time invested in the process? any other way around that?
It seems like no lawyer wants to provide a straight enough answer. I know it's a lot of questions but i really appreciate it.

Hi,
I have filed my H1 (premium processing)on 26th Sep and till now I didn't receive my H1 receipt.
What could be the reasons and how i Can track about my case.
Can I track my case? is there some number where i can call discuss about my case why I didn't receive my receipt
My Lawyer called the USCIS and they are saying that they are not able to generate the receipt number?
Is somebody else faced the same issue? what could be done now?

Earlier today, I mentioned this provision which would bar DHS from using funds to delay or rescind the no-match rule. The amendment passed by a voice vote, but in consulting with a knowledgeable source, it seems likely that the amendment will not have much affect. That's because it bars DHS from using funds from its 2010 budget for this purpose. As long as DHS rescinds the rule before September 30th (which now seems likely given yesterday's DHS announcement), no 2010 funds would be needed to achieve this result. So I would not count on the no-match letter being resurrected any...
