    Per old instructions everyone was sending to Nebraska, and new instructions published are for 'direct filing'.

    Do I follow direct filing rule or Nebraska only rule?

    I am finally ready with medicals and photos and will be sending packet tomorrow.

    I am working on L1B and also have H1B (without I94) from another employer
    I am filing L1B extension and H1B Change of Status at same time

    Situation 1) My L1B Extensions paper with (I94) comes prior to H1B change of status paper (with I94),
    which VISA will be applicable to me and my dependent spouse

    Situation 2) My L1B Extensions paper with (I94) comes after H1B change of status paper (with I94),

    i485 rfe for my wife. Please help

    My wife received an rfe for the things listed below. I think she got it because her finger prints are not machine readable and FBI have not been able to verify it....



    1) Submit true certfied copies of any and all arresting officers reports....blah blah blah


    2) Other: Local police clearance Letter from every place you have lived in united states

    My wife has been in US close to five years and lived in 2 cities

    MY question is

    for 1) she has never violated any law so does not have court disposition or anything of that sort so does she need
    anything for this?

    for 2) She has resided in 2 cities but also stayed in India for 4 months.
    The rfe clearly says "for every place lived in united states"
    so I would think she does not need a police clearance certificate
    from India


    Please help we have till march 5th to reply this RFE

    Anyone has any idea?

    I have approved I140 (EB3, PD:Nov'04) from previous employer; after getting my MBA (Jun'06), I have changed the job and my job description has also changed. New employer will file the labor after 3 months (HR Policy)..I have good relations with previous employer, they are ready to file I485. Is it possible to file I485(previous employer), while I am working with new employer?

    I am not sure but I came to know (not reliable source), that it is possible to file I485(previous employer) and during the interview, I can submit a support letter from the new employer. is this correct?

    Requesting your help..so near...but so far!!!!!

    Hi everyone,

    I have come to this form for help of one thing: for a long time I know that when switching jobs using ac21 you need to make sure that the job code is same and job description is similar, i know from my approved 140&perm that mine is 15-1032 (computer engineer),

    the job description of both company are 90% same.

    But they know nothing about the job code and ask me what is this code and where this is used . Can somebody help me with this?

    btw, my old job title is computer engineer, my new title is manager of computer system engineer. is that a problem ? if yes , if I asked them to demote that to computer system engineer leader, is it better?

    Based on USCIS's last action rule, the status of an applicant depends on whatever petition is approved last. So, if her H4 is approved after her H1 COS, then she will be on H4.

    I am assuming you have applied for H1/H4 extension recently in regular processing. So the chances of her H1 COS getting approved first under premium are higher. So once you get her H1 COS approval, just withdraw her H4 petition.

    USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case.     New I 140 possible in case of appeal pending on old I 140 rejection

    I'VE A QUESTION REGARDING I-140 case on appeal. The original approved PERM labor certification is in that case. In order to file new I140 Whether, I need to ask USCIS to withdraw that case and use my approved labor certification for this new I-140. But I am not sure how to accomplish that. Let me know if you have any helpful info.

    off the Topic! Sorry. Wondering if any IVian has good idea about itemized deductions we can take while working on 1099-MISC instead of on W-2? There might be good chunk of Spouses working on 1099 in IT or other areas of expertise while working on EAD.what kind of expenses where we need to save receipts while filing Taxes later on in '09.
