The Supreme Court issued its decision in the Arizona business license/e-Verification law of 2007 and by a 5-3 margin has upheld the law. This is the law that allows the state to revoke business licenses for firms knowingly hiring unauthorized workers and also mandating all employers use E-Verify. This was always going to be an easier case for Arizona than the defense of its 2010 law. In its press release, USCIS did not state how cases filed and rejected on the 2nd are to be handled other than to say that properly filed applications would be accepted. This presumably covers the many cases filed after the second that were held, but it doesn�t explain what will happen to the cases received earlier. We hope USCIS will issue special instructions to issue July 2nd receipt dates to those who are able to document they attempted to file. We presume some folks are still waiting on their July 2nd cases to be returned and are debating refiling new cases rather than waiting. Unfortunately, there is a risk of not getting the package back before August 17th and some people will need to refile without proof of the earlier filing. Hopefully, again, USCIS will institute a process for such individuals to avoid being penalized.

Hi,
I tried to search for this and could not find anything.
When dealing with 485 portability using EAD (with approved I140),
what happens if your underlying LC is a location/region/state bound and you end up moving to out of that specified region.
Job duties/job code can stay similar with probably salary increase.
Does the location violation get equated to unequal/dissimilar job duties resulting in 485 denial?
Chances are that should I have to invoke AC21 portability(due to layoff or something alike), I'll be facing this so I just want to be prepared for possibilities.

I am a US Citizen and just married an immigrant. Her situation is interesting. Upon arrival to the U.S. she was detained and an I275 was filled out but not submitted. Apparently, her visa had been expired due to an overstay in the distant past. The result of the detention was a Paroled status stamped on her pasport. No I-94
We met shortly after her entry and are currently maried. We want to self-file the I485/I130 papers but don't know how to proceed without an I94 number. If we submit an I102 will she get an I94 replacement or will they reduse based upon her Paroled status, whcih she has overstayed?
Please Help...

In theory, you can be the beneficiary of 2 H-1B petitions pending at the same time. This happens fairly often. Both could be approved and then you would be eligible to work for either company as long as that approval had not later been withdrawn.

I just want to know where is my "H1B Visa Extension Application" needs to apply by my employer.
Following are the details,
1. My Employer located in Virginia.
2. My current work location is Minnesota (and applying the H1extension with this Client's letter).
3. This is my second extension; i.e First H1b is for 2 years; and second H1b(i.e extension) for 3 years . all(5years) with the same employer.
4. I have approved I-140 also.
So 1) which will be the Service Center of mine to apply my H1B Extension
2) I heard Approved I-140 will be an advantage for a 3 year H1 extension application, but do this really matter if I have 3 months Purchase order or Contract with the client.
Please let me know.

I am...but most of you ain't, so I figured that it made more sense to use an image you'd be more familiar with.
