One can contiue to stay using I-485 receipt without valid I-94. afasik I-797 can be used only if you filed H1 extention after you came back on parolee.
If a person travels on AP, he will get a new PAROLE I-94 which shows expiry date of 1 year from the day he entered on AP. Can the person stay in US AFTER that expiry date and continue working using a valid I-797?

My h1b expires of 09/30/2010.
my drivers license expires on 5/31/2010.
I have ead that expires in jan 2011.
my h1b extension will be filed around june 2010.
can I use ead card to renew my drivers license till jan 2011.
around jan 2011 I could use extended h1b to renew my drivers license.
Can I do this. All I want to use my EAD card is for drivers license renewal.

Hi,
I got my H1b approved this year. My first name is set to FNU and my full name was added in last name. Now i have got it corrected in my passport as it was wrong in the first place. After my passport was corrected, I was advised to apply for H1B amendment. I have applied for H1B amendment in November. Also I was unable to get my SSN bcos of this name issue and SSN office is demanding to get I797 corrected before issuing the SSN. Now since I am waiting for my SSN and H1B amanedment. I am not paid. I want to know if I am still legal and I am in status? Please let me know the process I should follow if there are any?
This is extremely urgent and any help/advice in thsi regard wil lbe great.

I have applied for EAD renewal on September 1 2010. I have received receipt notice and checks are cashed . There was soft LUD on my case two weeks back without any change in status . To day I got email with case status � Initial Review� with following messsage
We have placed this case I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION on hold because there is a pending litigation that may affect the outcome. We will resume processing as soon as the litigation is resolved. We will notify you by mail when we make a decision about your case, or if the office needs additional information.
This is my 5th my EAD Renewal and earlier I do not have any issues with Renewals . My current EAD Expires in December 1 Week . I am in H1B visa (valid until 10/2011), my wife is in F1 student (valid until 8/2011). We just got married 1 month ago in US. currently, we are staying in US. Now, she would like to stop studying for some reasons. To keep her valid stay in US, I have to transfer her f1 to h4. Could you please let me know step by step what I should do, what form I should take…etc.
Does she need any visa interview after filing the transferring f1 to H4?
Can she inform the school that she will stop studying right after filing visa transferring? (the school will stop her f1 if they know that).

New numbers are out on H-1B usage and the past week showed a substantial pickup in usage with more than 1700 numbers counted against the cap of 65,000. 36,600 H-1Bs have been counted now. I'm moving my exhaustion projection date up about two weeks. My target is based on a rolling four week usage average so variations from week to week are discounted. She will have to go out of country and get stamping for H4 if her spouse is maintaining H1.

I have 2 clarifications
a)Anyone has a clue on what an Employment Development department letter means? Is this the same as the 45 day acknowledgement letter from DOL?
b) In the absence of an 45 day acknowledgment letter from DOL, how else can we get a confirmation that our case has been filed with DOL. As per our company Attorney DOL is not issuing the 45 day letter. Can I ask for a screen shot. I saw some threads on that.. How do I ask for a screen shot of my case ? Any specific procedure? What is the response time for receving the screen shot? Do you need to specify a reason for asking screen shot?

We like to share that the H1B cap is extremely close to being reached. The count as of December 15, 2009 is 64,200. This is 1300 cases more than the count from December 11th. This count is very close to the total cap of 65,000 which is actually somewhat reduced by numbers allocated under trade agreements. We continue to watch this very closely, and will provide updates until the FY 2010 cap is reached.
We suggest to act quickly to avoid last minute embarrassment as H-1B Cap may soon be cease to exist.

I got my H1-B visa on June 29, 2005 , I came to india on Jan 2009 . From Jan 2009 till now I have been staying in India , bcoz I was taking care of my new born daughter, now she is grown up and now I am planning to start working in US. Right now I got my H4 visa .
I came to know from someone that H1-B filing for this year was over in Jan 2011, so if I need to file a new H1-b , I have to file now and I will be eligible to work after Oct 1 this year. Is it true ? Is it not possible that a company files for a new H1-B under premium processing and I start working after 2 weeks of filing ? I don't want to wait that long(Oct 1) to work , I have few oppurinities coming up where I may get selected.

Thank you. I checked it out. My nephew (7yrs) also plans to come for 3 weeks with my in laws. He has never been to the US before, and his parents are not coming either. The site mentioned that parents visa papers also have to be attached, I am not sure what this means. (His parents have never applied for the visa)

Need advice on how to reopen a bia appeal. We have vacated an aggravated felony Sept 25 that precluded any relief. Ninth circuit review pending and im seeking an extension on the opening brief until I find out bia status. The question I have is if i should just use IAC as an argument or just try to reopen based on a material change? I dont want to open a "can or worms" but the attorney throughout the 5 year court proceedure never advise to vacate or any post conviction remedies. Bia appeal decision Apr 29/09 is past the ninty days.

I need to get my H1B stamped in Mexico. I know there are some agencies which offer a complete package trip to the Mexico US Consulate. Does anybody know some names and contact information?
I am based in Los Angeles and am pretty close to Mexico border. Do they have something in Southern California? Other places are also Ok.

I am a strong supporter of Comprehensive Immigraton Reform (CIR). I have been on both sides of the fence.
