Stuart Anderson, one of the top thinkers on immigration policy, has written a new paper for the National Foundation for American Policy entitled "A New Immigrant Entrepreneur Visa Aimed at Job Creation in America". Most of the employment related bills for skilled labor in the CIR were pretty much sponsored by Republicans.
I am wondering what kind of resistance, if at all, is the IV seeing in democratic controlled senate and congress seeing since these bills can be viewed as big business-supported or republican supported.
It would be good to get more democrats to sponsor these bills rathar just have them give lip service to our cause since they have the majority.

Hi,
I just filed I-485 for myself and my wife. She is currently on OPT and has an approved EAD (F-1).
I can't seems to get a definite answer on how the filing will affect her status. Here's what I know so far, pls correct me if I am wrong:
1) F-1 is non-immigrant intent. Hence, when the I-485 is submitted she is no longer on F-1 but "AOS pending" status.
2) She "can" continue to work using the EAD. I said "can" because technically she is not supposed to but this is a grey area.
3) The PROBLEM is when she decides to travel. There is high risk that the immigration officer will see that she has filed I-485 and hence her F-1/OPT is no longer valid.
4) The PROBLEM in (3) can be circummvent if she uses AP from the I-485 application.
Am I missing anything? Thanks.

Cousin of my friend got an email that his card production has been ordered.
He falls in EB3I (PD Aug. 2005). I could not believe it but my friend told me that
EB3I would see significant movement in coming months.

1500 H-1Bs were claimed in the last week and just over 20,000 remain for the fiscal year. Based on a four week rolling average (1175), I am projecting the target will be exhausted in 17 weeks which will be February 23, 2011. Previously, I had been projecting March, but the overall usage of H-1Bs has been somewhat busier in the last month than in previous months. Since ur I-485 is approved which means you will get Green card in abt week to 10 days they have denied EAD. So there is nothing to be concerned.

My last H1 transfer gave me a 3yr H1 approval. But in reality, this will make it 1 year more than the 6 years allowed. My Perm and 140 are approved before the 6th year ended and my company filed a H1B amendment request just a day before 6th year ended. It is still pending. Now, my wife is in india and she has to get back here for filing 485 in july. Can I use my existing H1 to apply for visa in this situation?

i was in same situation. my wife's AP was approved and mine not, before leaving US, so i went for h1 stamping but, my wife didnt. on return, i entered on H1 and she entered on AP.
SFO port. they asked her to go to secondary inspection room, had to wait for 1/2 hr. they called her name, no questions asked, gave her docs back. we both were in.
this was back in Feb'09. i work directly for F100, popular company.

There's a phrase in American pop culture - "jump the shark" that seems appropriate about now. I guess in the facing rapidly declining ratings, Mr. Dobbs is resorting to even more extreme rhetoric and has now joined the "birthers" desperately peddling one of the sillier conspiracy theories out there. While it showed weak moral stamina, I could at least understand the economic reasoning behind CNN keeping Dobbs on the air when his show was producing healthy ratings. But even that justification for leaving him in prime time has evaporated. It's time to pull the plug. Hat tip to George C....
