My heart jumps with joy, but my brain still caution the heart to wait for the official visa bulletin at DOS/USCIS website. USCIS has a trend of "correcting" the visa bulletin. Nevertheless, if the dates are really what they are published at Mumbai site, its a time for us to be happy.
EB2 looks promising, but in this moment of joy lets not forget our friends in EB3 category. Anyone whose priority date is current, please don't just move forward with your joy, and continue to support IV and our initiatives to help legal immigrants. We have suffered so much because the folks who came prior to us never bothered to support legal immigration, once they got their their GC. Please remember that after GC/Citizenship, our status in this nation as a minority group depends on how active we are socially/politically.

3) we do not need internecine fights, that digress's from our mission.

My PD is October 2003 (EB2 India) and I have always detested the fact that in some states the LC used to be approved very fast. If I remember correctly, the LC approvals used to have a state-wise bulletins prior to PERM and there was a time when in states like Maine, some got their GCs within a year of filing their LC. The majority unlucky ones got stuck in red tape racist states and LCs were moved to BECs.
priti888's LC was approved before December 2004 and she was able to file I-140 + I-485 concurrently in December 2004 becuase EB3 India was 'C' in December 2004 VB (http://travel.state.gov/visa/frvi/bulletin/bulletin_1343.html).
The title of the thread if funny (like the Monday Headlines in Jay Leno's Show) - card production ordered!!! July 23th :) instead of July 23rd

Visa Allotment or Assigning of Visas by USCIS - I cannot digest the assumption that USCIS/DOS/DOL are fools and there is no coordination among them to know who from which country has applied for GC under which category. These Govt. agencies are so efficient that they can even go through these forums and connect IDs here to applications. It is a piece of cake for them to find out the entire background of an applicant as soon as even the LC is filed. They very well know who is stuck with which employer in which state and what stage and to whom they are approving the GCs. If the employers are Americans, they can even call the DOL and ask them to hold the LC approval because they know that once their employees get their GCs they will quit them.
I am not trying to be negative and pessimistic, but please think about the chances of immigrants sueing these Govt. agencies during any of the stages in GC process and winning the lawsuit. And ofcourse, the immigration lawyers are too happy with the retrogressions and the way the immigration system works in this country.

Inspite of the new spillover policy and the additional FB visa's the EB2-I has retrogressed. This shows there is quite a bit of EB2-I demand. Regarding EB3I movement, donno when it will come out of the 2001 slump. The actual bulletin might show the ROW movement that could provide some hint to how the spillover can influence the EB2I forward movements.

even if it is available, the principal applicant wont be able to take real advantage of it. As you cannot switch to company B, without invoking AC21, which kicks in only 180 days after, filing 485.

I agree with you regarding the timeline and evidence. I have mentioned it to my attorney numerous times. My attorney was insistent that adjudicating officers can see all my info on their computer screens. It is only a matter of looking at the info correctly.
It looks like the first MTR went to the same IO who denied my I-485. I could say it from ID in both the denial letters.
Well - I think it was a dirty little trick where supervisor was convinced that this is not an AC21 case and did not even bother to look up your case information.
This is definitely a slap on the face of honesty and integrity

Wishful thinking aside - realistically speaking, it's zilch. As USCIS seems to have predicted, even with spillover implemented the PD isn't moving to 2006 any time soon.
